General Terms and Conditions

1. These terms and conditions relate to the ITV Bingo website located at www.itvbingo.com ("Website"). The Website is managed by Cashcade Limited ("Cashcade") and brands on the Website, including without limitation "ITV Bingo" and "ITV", are owned by ITV Broadcasting Limited ("ITV") or companies in ITV's group or are used under licence.
2. The games Cashcade promotes on this Website are operated by Cassava Enterprises (Gibraltar) Limited (the "Company", "we", "our"), a subsidiary of 888 Holdings plc, under its remote gambling licence issued by the Government of Gibraltar (RGL No. 022). The games are powered by software belonging to Brigend Limited ("Brigend"). Brigend is a wholly-owned subsidiary of Cassava and both companies are Gibraltan.
3. When you use this Website, open an account and play games you enter into a legally binding contract with the Company as it operates this Website and the games promoted by Cashcade on it. This legally binding contract is subject to the terms and conditions set out below, the privacy policy and the game rules displayed on this Website from time to time together with any and all other applicable terms and conditions (the "Terms and Conditions").
4. By registering and playing on this Website you agree to comply with the Terms and Conditions.
5. This Website is restricted to individuals who are eighteen years of age and older. You cannot play under any circumstances if you are not at least eighteen years of age. The Company reserves the right to request proof of your age at any time and may cancel your account if such proof is not provided.
6. All transactions between you and the Company take place on the Company's servers in Gibraltar.
7. Participation in the activities and games on this Website (the "Games") is open only to residents of the United Kingdom (unless the Company determines otherwise) and the Company reserves the right at any time to close accounts registered from outside that jurisdiction.
8. None of the Company, ITV or any group company of ITV make any representations or warranties, implicit or explicit, as to your legal right to participate in the Games nor shall any of the Company's, ITV's or any group company of ITV's employees, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents or retailers have the authority to make any such representations or warranties.
9. Employees of the Company, Cashcade and ITV and their respective group companies, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners and retailers, and members of the immediate families of each, are not eligible to participate in the Games.
10. Any participation in the Games is at your sole option, discretion and risk. By playing the Games, you acknowledge that you do not find the Games or the Website to be offensive, objectionable, unfair, or indecent.
11. You are only permitted to use the Website for your own personal entertainment and non-professional use. Any other entrance, access, use or reuse of the Website is strictly prohibited.
12. Only one account per person is permitted for which you must register using your own actual name. Unfortunately, this is necessary to prevent abuse of our generous "free money" policies. All payments into your account must be from a registered payment source(s) (e.g. a debit or credit card) on which you are the named account holder. You may not register more than five (5) payment methods on ITV Bingo. No interest is payable on the balance in your account. Please note that administration charges may apply for periods of inactivity (see below).
13. The Company reserves the right to withhold payment to any player pending verification of the player's identity. All details which you provide to the Company either during the registration process or at any time thereafter must be true. We reserve the right to run checks with third party agencies using the information you provide us on registration.
14. We make every effort to ensure that errors or mistakes do not occur in any Game. We reserve the right to void winnings or cash-ins enabled by wins resulting from any obvious error or mistake or any technical fault (including, but not limited to, incorrect game payouts) with any of the Games offered. You will forfeit any winnings/losses that result from such errors or mistakes or technical faults.

Games Terms and Conditions

1. A new game is played every 3 to 5 minutes.
2. A new ball is called every 3 seconds.
3. There is a 1 card minimum purchase per game.The maximum purchase may be different between Games and will be set out when you play a Game.
4. Bingo is played in "Autoplay" mode, whereby players will always be notified of a winning bingo card.
5. The purchase of all cards is final.
6. In the case of there being more than one winning card, the prize will be split equally amongst the number of winners.

Instant Win - Game Disputes

If you feel that a Game has played out unfairly then you must contact our Customer Support team with the Game ID and a screenshot of the Game as it finished for us to assist you.

To take a screenshot:
If you are using a PC, first press the "Print Screen" button (it may say "Print Scrn" or "PrtScn"). Then open a new file in an imaging programme such as Microsoft Paint, click on "Edit" and select "Paste", then click on "File" and select "Save As", browse for the folder where you want to save the image, name the file and choose a file type (for example JPEG).

If you are using a Mac, first select the screen you wish to capture, then press the "Apple" key, shift and 4 all together and release. The mouse cursor will change to a "+", press the space bar once and the cursor will change into a camera, make sure the camera is still over the screen you want to grab, click and a screenshot with a file name of "Picture" will be saved to your desktop.

IMPORTANT NOTE: The outcome of every Game is determined by a random number generator. The window in which you play the game displays a graphical representation of that outcome. In an instance where the flash game display fails to show any result, the Game will still have been completed on our servers. In the event of a loss the stake will still be deducted from your account and in the event of a win the winnings will still be credited to your account.

Account Cancellation

The Company reserves the right to cancel your account for any reason whatsoever at any time without notice to you. Any balance in your account at the time of such cancellation will be credited to your credit card and/or sent to you by cheque. However, the Company reserves the right, in its unfettered discretion, to void any winnings and confiscate any balance in your account in any of the following circumstances:

Your account may be cancelled :

1. If you have more than one active account for the Website;
2. If the name on your account does not match the name on the credit card(s) used to make purchases on your account;
3. If you participate in a promotion and cashout before fulfilling the requirements of that particular promotion;
4. If you provide incorrect or misleading registration information;
5. If you are not eighteen years of age or older;
6. If you are not a resident of the UK;
7. If you have allowed or permitted (intentionally or unintentionally) someone else to play on your Bingo account;
8. If you have not played Bingo on an individual basis for personal entertainment only (that is, you have played in a professional sense or in concert with other player(s) as part of a club, group, etc.);
9. If you have "charged back" any of the purchases made with your credit card on your Bingo account;
10. If you are found cheating or if it is determined by the Company that you have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the Website;
11. If the Company believes that you are using the Website for any unlawful or fraudulent activity (including money laundering) in any jurisdiction that applies to you, the Company or ITV or if the Company believes that you are in breach of the Terms and Conditions; OR
12. If the Company should become aware that you have played at any other on-line Bingo under any of the circumstances set out at 1 to 11 above.
13. By accepting any prize and/or winnings from the Company, you consent to the use of your name by ITV for advertising and promotional purposes without additional compensation except where prohibited by law;
14. If you have any dispute with regard to any outcome in a Game, you must submit your complaint to the Company in writing within fourteen (14) days. The Company's contact details are available here. In the event of a discrepancy between the result showing on your software and the Company's server software, the result showing on the Company's server software shall be the official and governing result of the Game
15. You are solely responsible for any applicable taxes on any prizes and/or winnings that you collect from the Company
16. The Company reserves the right, in its sole discretion and without notice to you, to add new activities or games to the Website or to discontinue any activity or game at any time.
17. If you do not log onto your account for a period of 180 days (such period starting on the date of your last login to that account) any balance in your account at that time may be subject to a monthly administration fee of 10% of such balance. This fee will be deducted from your account on the 181st day and every 30 days thereafter during which your account remains inactive until the balance of your account has reached zero. If you login to your account before the balance is zero, the administration fee will no longer be payable but the Company shall not be required to return to you previous administration fees deducted from your account.
18. You are solely responsible for keeping your username and password secure and secret. You shall not allow any other person or third party including, without limitation, any minor, to use or reuse your account, access and/or use any materials or information from the Website, accept any prize, or participate in the Games. You are solely responsible for any purchases and/or losses that may occur on your account.
19. The Company shall not be required to maintain usernames or passwords if the Player misplaces, forgets, loses, or is otherwise unable to enter the Website because of anything other than the Company's error.
20. None of the Company, ITV or any ITV group company shall be liable for computer or Internet malfunctions nor attempts by the Player to participate in the Games by methods, means or ways not intended by the Company.
21. If you are found to be cheating or attempting to defraud the Website, or if you make untrue and/or malicious comments with regard to the operations of the Company or ITV, the Company reserves the right to publicize your actions together with your identity and e-mail address, as well as to circulate this information to other bingo and gaming companies, banks, credit card companies, and appropriate agencies.
22. You agree to pay for any and all costs, expenses, liabilities and/or damages incurred by the Company, ITV and/or any group company of ITV and their employees, officers, directors, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents and retailers that may arise as a result of: (i) your entry, use, or reuse of the Website, (ii) your use of any materials at the Website, (iii) your entry, use, or reuse of the Company's server, (iv) your participation in the Games, or, (v) your acceptance of any prize.
23. All intellectual property rights (including, but not limited to, all trade mark rights and copyright) in the brands used on the Website, including without limitation "ITV" and "ITV Bingo", vest in companies in ITV's group or their licensors. You agree that you will not display or use such brands in any manner unless you have received prior written consent to do so from the relevant company in ITV's group or its licensor. All intellectual property rights (including, but not limited to, all copyright) in the Website's graphic user interface, content and look and feel vest in Cashcade and you agree that you will not display or use the Website's graphic user interface, content or look and feel in any manner unless you have been given Cashcade's prior written consent to do so.
24. Materials of the Games (whether electronically obtained or obtained by other means) are automatically void if counterfeited, mutilated, forged, altered or tampered with in any way, if illegible, mechanically or electronically reproduced, obtained outside authorised legitimate channels or if they contain printing, production, typographical, mechanical, electronic or any other errors. Liability for materials of the Games containing any error is limited to replacement of same.
25. Any and all materials submitted for prize claims become the property of the Company and will not be returned. None of the Company, ITV or any ITV group company are responsible for lost, late, illegible, incomplete, damaged, mutilated, misdirected, or postage due mail, requests, prize claims or entries.
26. We recommend that customers print out these Terms and Conditions, all transaction data, rules of the Games and payment methods and keep them in an easily accessible place. Please note that only data from the previous three months will be available for you to view at any one time.
27. The minimum purchase on the site is £5. The denominations of the purchases are £5, £10, £20, £50, £100, £200 and £500.
28. The Company reserves the right to amend these Terms and Conditions, or to implement or amend any procedures, at any time. We will notify you of such amendments by publishing the updated Terms and Conditions on the Website, which will take effect 7 days after such publication. By continuing to participate in the Games after this 7 day period you will be accepting the changes to the Terms and Conditions. Procedural changes will only be in response to the interests and security of the Website or the players.
29. The Terms and Conditions contained herein represent the complete, final and exclusive agreement between you and the Company and supersede and merge all prior agreements, representations and understandings between you and the Company with regards to using the Website.
30. The Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales (or the laws of Scotland or Northern Ireland if you live there).
31. Please note that additional terms and conditions, including (without limitation), the Promotional Terms and Conditions, will apply for bonuses (including free Games or credit), loyalty schemes, certain prizes and other promotional offers in relation to the Website and you should review these specific terms and conditions when applicable.

Terms and Conditions relating to Chat

A "chat facility" is available on the Website which allows you to communicate with other users who are participating in the Games.

The Company reserves the right to monitor the chat facility and keep a record of all statements made by any user on such facility.

Your use of the chat facility is subject to the following:

(a) You shall not make any statements that are racist, obscene, vulgar, indecent, sexually explicit, offensive, abusive, threatening, defamatory or insulting.

(b) You shall not make any statements that breach the rights of others (including copyright and other intellectual property rights).

(c) You shall not make statements about the Company, Cashcade, ITV or any group company of ITV (including, without limitation, about any programming produced and/or broadcast by a member of ITV's group) that are untrue, malicious and/or damaging to such company.

(d) You shall not submit your personal data via the chat facility or use any personal data submitted by other users of the Website via the chat facility.

(e) You shall not "spam" the chat facility with multiple postings or commercial solicitations for other products or services.

(f) You shall comply with the Chat Room Guidelines.

The Company shall have the right to immediately remove any content posted on the chat facility which the Company and/or ITV deem, in their sole discretion, to be in breach of paragraphs (a) to (e) above.

Furthermore, if you breach any of paragraphs (a) to (e) above then the Company shall be entitled to immediately ban you from any future use of the chat facility or terminate your account and refund you any monies in such account. You agree that you will compensate the Company, Cashcade or any ITV group company for any loss or damage caused by your breach of any of paragraphs (a) to (e) above.

The Company and ITV are not responsible for any uses of the personal data that you choose to submit via the chat facility in breach of paragraph (d) above or any other problems arising from the content which you submit via the chat facility.
